These Terms of Service ("Terms") govern your use of Infinite Jewels (the "Game") and nctrnlstudios.com (the "Site"), provided by Nocturnal Studios LLC. By downloading or using the Game, or using the Site, you agree to these Terms. If you do not agree, do not use them.
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Game for your own non-commercial entertainment, subject to these Terms and the App Store Terms of Service.
The Game offers optional in-app purchases, including virtual currency ("JWL Shards") and other virtual items (e.g., extra moves, life refills, Shard packs).
Virtual currency and virtual items are a limited license to use them inside the Game. They have no monetary value, cannot be exchanged for real money or transferred, and you do not "own" them.
All purchases are processed by Apple and are subject to Apple's terms. All sales are final and non-refundable except where required by law or by Apple's refund policies.
We may add, remove, modify, or re-balance virtual items, prices, and the in-game economy at any time. Virtual items may be forfeited if your access to the Game ends.
The Game uses a lives system in Adventure mode that replenishes over time. Lives are part of the gameplay design and, like other in-game elements, have no monetary value.
You agree not to: cheat, exploit bugs for unfair advantage, use unauthorized third-party software or bots, reverse engineer or tamper with the Game, disrupt our services, or infringe others' rights.
The Game and Site — including all art, characters (including Dr. Noctu), music, sound, code, logos, and the names "Infinite Jewels" and "Nocturnal Studios" — are owned by Nocturnal Studios LLC and protected by law. You may not copy, distribute, or create derivative works without our written permission.
The Game and Site are provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that they will be uninterrupted, error-free, or secure.
To the fullest extent permitted by law, Nocturnal Studios LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data or profits, arising from your use of the Game or Site. Our total liability for any claim will not exceed the greater of the amount you paid us in the 12 months before the claim or US $50.
We may suspend or terminate your access if you violate these Terms. You may stop using the Game at any time by deleting it.
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules.

These Terms are between you and Nocturnal Studios LLC only, not Apple. Apple is not responsible for the Game or its content.
Apple has no obligation to provide maintenance or support for the Game.
Apple is not responsible for addressing any claims relating to the Game (including product liability, legal/regulatory compliance, or consumer protection claims).
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
You represent that you are not located in a U.S.-embargoed country or on a U.S. prohibited- parties list.
We may update these Terms; material changes will be posted here with a new "Last updated" date. Continued use after changes means you accept them.
